1. Eligibility

You must be at least 21 years of age to use this Site or purchase any products from us. By using the Site, you represent and warrant that you are 21 or older. We reserve the right to refuse service to anyone we have reason to believe is under 21.

The Site is available to customers located within the United States only. By placing an order, you confirm that your shipping address is within the United States and that you are aware of and comply with the laws of your state regarding the purchase, possession, and cultivation of cannabis seeds.

2. Legal Disclaimer Regarding Seeds

Cannabis seeds are sold by Gold Hill Seeds strictly for the following purposes only: storage, collection, and souvenir purposes in jurisdictions where cultivation is not permitted. In states where adult-use or medical cannabis cultivation is legal under state law, seeds may be purchased for cultivation in compliance with applicable state regulations.

It is your sole responsibility to know and comply with the laws of your state and local jurisdiction before purchasing. Federal law in the United States classifies cannabis as a Schedule I controlled substance. We make no representation that the purchase, possession, or use of cannabis seeds is legal in your jurisdiction.

By purchasing seeds from Gold Hill Seeds, you assume all legal responsibility for your use of those seeds. Gold Hill Seeds accepts no liability for any legal consequences arising from the purchase or use of seeds sold through this Site.

3. How Orders Work

Gold Hill Seeds operates as a multi-breeder catalog. When you place an order, we purchase the seeds from the relevant breeder on your behalf and arrange for the breeder to ship directly to your address. Your order is a contract with Gold Hill Seeds, not with the individual breeder.

If your order includes products from more than one breeder, you will receive separate shipments. Each is fulfilled independently and will arrive with its own tracking information. Order confirmation does not guarantee immediate availability. In the rare event a product becomes unavailable after your order is placed, we will notify you and offer a full refund or a suitable alternative.

4. Pricing and Payment

All prices are listed in US dollars. We reserve the right to update pricing at any time. The price charged at the time of purchase is final. Promotional pricing is valid only for the duration of the stated promotion.

Payment is due in full at the time of order. We accept major credit and debit cards. Your payment information is transmitted securely to our payment processor. We do not store card details on our servers. By submitting a payment, you represent that you are authorized to use the payment method provided.

5. Shipping

Shipping is fulfilled by our breeder partners as described in our Shipping & Returns Policy. Estimated delivery times are provided as a guide and are not guaranteed. Gold Hill Seeds is not responsible for delays caused by carriers, customs, or circumstances outside our control. Risk of loss passes to you upon handoff to the carrier.

6. Returns and Refunds

Our return and refund terms are detailed in our Return Policy. Unopened seed packs may be returned within 14 days of delivery. Opened packs are covered by our Germination Guarantee rather than standard returns. All returns must be initiated by contacting us before shipping anything back.

7. Germination Guarantee

The full terms of our germination guarantee are available on the Germination Guarantee page. The guarantee applies only to seeds germinated using a standard method under the conditions specified on that page. Claims must be submitted within 30 days of order receipt with supporting documentation.

8. Account Registration

Creating an account is optional but required to view order history and access certain features. You are responsible for maintaining the security of your account credentials. You must not share your login with others or allow unauthorized access to your account.

You must provide accurate and complete information when creating an account. We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in fraudulent activity.

9. Prohibited Conduct

You agree not to:

• Use the Site if you are under 21 years of age
• Place orders to a jurisdiction outside the United States
• Resell products purchased through the Site without our prior written consent
• Attempt to circumvent any age verification or geo-restriction measures on the Site
• Submit false or fraudulent orders, returns, or germination claims
• Use automated tools, bots, or scrapers to access the Site
• Attempt to gain unauthorized access to any part of the Site or its infrastructure
• Post, transmit, or share content that is unlawful, harassing, defamatory, or infringing
• Use the Site in any way that violates applicable federal, state, or local laws

10. Intellectual Property

All content on the Site -- including text, images, logos, product photography, guides, and design -- is the property of Gold Hill Seeds or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, republish, or create derivative works from any content on the Site without prior written permission. Breeder names and logos are the property of their respective owners and are used with permission.

11. Disclaimer of Warranties

The Site and its content are provided “as is” and “as available” without warranty of any kind. To the fullest extent permitted by law, Gold Hill Seeds disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses. Strain information including THC percentages, yield estimates, and flowering times are sourced from breeders and provided as a guide only. Actual results may vary based on growing conditions, experience, and environment.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Gold Hill Seeds and its owners, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any products purchased through it, including but not limited to loss of profits, data, or goodwill. Our total liability for any claim arising from a purchase is limited to the amount you paid for the specific order giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless Gold Hill Seeds and its owners, employees, and partners from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Site, your purchase or use of seeds, your violation of these Terms, or your violation of any applicable law.

14. Governing Law and Disputes

These Terms are governed by the laws of the United States. Any dispute arising from these Terms or your use of the Site that cannot be resolved informally shall be submitted to binding arbitration in accordance with the American Arbitration Association rules. You waive any right to a jury trial or to participate in a class action lawsuit. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction for matters involving intellectual property or unauthorized access.

We may update these Terms at any time. When we do, we will revise the effective date at the top of this page. For material changes, we will notify registered account holders by email. Continued use of the Site after updated Terms are posted constitutes your acceptance of the revised Terms.
